Michael Sellers Comment On Regulatory Notice 22-08

Comments: I acknowledge that leveraged ETF's can be extremely volatile and not suitable for every investor but for should be available for those that choose them. There are extreme risks everywhere. It's up to each investor to manage their cash and risk tolerance. It's fine to put warning labels on the package but don't restrict the sale. I can illustrate many cases of individual stocks being way more risky and volatile than a a leveraged index ETF.

Public investments should be available to all of the public, not just the privileged. This regulation is a smoke screen for increasing institutional control of retail investors, when the real issues lie with larger market forces.

Please don't require retail investors to jump through a series of hoops to continue utilizing leveraged and inverse funds as tools to protect our investments.

It is most imperative that action to restrict my right to invest be stopped now. I should have the right to choose the public investments for myself and my family. I should not have to pass a test nor get any kind of special approval. I am perfectly capable of understanding leveraged and inverse funds and their risks. It is important I continue to have the right to make my own decisions on how to protect my family's future.
